An accident involving six vehicles on Texas 80 near San Marcos resulted in the death of one man and injuries to nine other people. Police are investigating another man for intoxication manslaughter for causing the July 4 accident.
According to police, the wreck began when a Dodge Neon crashed into a Nissan Altima from behind, pushing the Nissan into oncoming traffic. The 25-year-old male driver of the Nissan, from Woodlands, had been about to turn left onto County Road 101 from Texas 80 when the Dodge failed to stop and hit the Nissan. The Nissan was then hit by another car and a truck. This impact pushed the Nissan, which then collided with a Department of Public Safety vehicle. A sixth vehicle was also involved in the accident.
The driver of the Nissan was declared dead at Central Texas Medical Center in San Marcos. Nine other people were taken to the hospital for treatment. Seven were released, but two remained in the hospital in serious condition. A 22-year-old man and a 29-year-old man, both passengers in the Altima, were still at Brackenridge Hospital. A 20-year-old Kyle man, who was transported to Brackenridge Hospital via Star Flight and later released, wass under investigation for intoxication manslaughter for his role in the car accident.
In cases like this, a personal injury lawyer might advise the family of the decedent and the injured victims to file claims for damages once the police investigation is completed and liability is established. For example a lawyer might use an intoxication manslaughter charge, if there is one, to show negligence. If a successful claim is filed, there are different types of damages that can be recovered, including remuneration for hospital costs, funeral and burial costs, and for pain and suffering.
