A fatal accident in Austin between a car and a motorcycle reportedly ended in the death of the motorcyclist. According to police, the accident occurred around 7 p.m. on Aug. 12.
Police said the fatal collision occurred at an intersection when a westbound sedan failed to yield the right-of-way and unlawfully turned into an eastbound motorcycle, causing the motorcyclist to crash into the car’s passenger side. The man riding the bike was instantly killed at the scene. The sedan driver did not report any injuries; however, a passenger was transported to a local hospital for treatment of non-fatal injuries.
Authorities who arrived at the scene closed one of the eastbound lanes while investigators processed the area. The investigation was pending at the time of the report, but police did not suspect alcohol to be a contributing factor. It was also reported that authorities were not planning to file any criminal charges against anyone in the incident.
Surviving family members of a loved one who was killed in a motorcycle accident may have recourse to file a wrongful death lawsuit if they believe the crash was caused by a negligent driver. A lawyer may be able to use information from police reports and eyewitness accounts to substantiate the family’s claim in a civil court. If the claim is successful, the family could receive restitution for any accident-related damages such as medical costs, funeral costs and lost income. In some cases, the family might also be awarded for non-monetary losses such as loss of consortium.
